These Terms apply to all visitors, users, and others who access or use the Service. By accessing and using this Service, you accept and agree to be bound by the terms and provision of this agreement.

Carbon Sky Index reserves the right to update and change the Terms of Service from time to time without notice. Any new features that augment or enhance the current Service, including the release of new tools and resources, shall be subject to the Terms of Service.

You may not use our Service for any illegal or unauthorized purpose nor may you, in the use of the Service, violate any laws in your jurisdiction. You must not transmit any worms or viruses or any code of a destructive nature.

You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service without the express written permission by Carbon Sky Index.

Specifically prohibited activities include but are not limited to:

• Reverse engineering or attempting to extract source code
• Using automated systems to access the platform without permission
• Sharing account credentials with unauthorized parties
• Attempting to circumvent usage limitations or access controls

When you create an account with us, you must provide information that is accurate, complete, and current at all times. You are responsible for safeguarding the password and for maintaining the confidentiality of your account.

You are responsible for all activities that occur under your account and password. You may not use as a username the name of another person or entity that is not lawfully available for use.

Carbon Sky Index reserves the right to refuse service, terminate accounts, remove or edit content, or cancel orders in our sole discretion. We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

Upon termination, your right to use the Service will cease immediately. If you wish to terminate your account, you may simply discontinue using the Service or contact our support team.

Carbon Sky Index provides aviation emissions intelligence data and analytics. Your use of this data is subject to specific licensing terms and restrictions outlined in your subscription agreement.

You may use the data provided by Carbon Sky Index for internal business purposes only. Redistribution, resale, or commercial exploitation of raw data is strictly prohibited without explicit written consent.

All intellectual property rights in the Service and the data provided remain with Carbon Sky Index or our licensors. You are granted a limited, non-exclusive, non-transferable license to use the Service during your subscription period.

You acknowledge that the aviation emissions data is provided for informational purposes and should not be the sole basis for critical business or regulatory decisions without additional verification.

Subscription fees are billed in advance on a monthly or annual basis and are non-refundable. There will be no refunds or credits for partial months of service, upgrade/downgrade refunds, or refunds for months unused with an open account.

All fees are exclusive of all taxes, levies, or duties imposed by taxing authorities. Where required, you shall be responsible for payment of all such taxes, levies, or duties.

Carbon Sky Index reserves the right to change pricing at any time. If you are on a monthly subscription, price changes will take effect in the next billing cycle. Annual subscribers will be notified of price changes at least 30 days before their renewal date.

Failure to pay any fees or charges when due will result in the immediate suspension of your access to the Service until payment is received.

Carbon Sky Index reserves the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days notice prior to any new terms taking effect.

We may also, in the future, offer new services and/or features through the website. Such new features and/or services shall be subject to the terms and conditions of this agreement.

Either party may terminate this agreement at any time with or without cause. Upon termination, all rights and obligations under these Terms will cease, except for those that by their nature should survive termination.

In the event of termination, you will lose access to your account and all data associated with it. We recommend exporting any critical data before termination.

Any disputes arising out of or related to these Terms or the Service will be resolved through binding arbitration, rather than in court, except that you may assert claims in small claims court if your claims qualify.

These Terms and any action related thereto will be governed by the laws of Delaware without regard to conflict of laws provisions. The exclusive jurisdiction for any action or proceeding arising under these Terms shall be the state and federal courts located in Delaware.

If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced to the fullest extent under law.
